LIMITED WARRANTY ON DEALERSHIP SERVICES
WHO IS COVERED:
- Our Dealership, whose name and address are identified on this Repair Order/Invoice, offers this Limited Warranty to you, the Customer listed on this Repair Order/Invoice, and it cannot be transferred to any other person.
- Only you, and any person who is entitled under applicable state law, may enforce the obligations under this Limited Warranty.
- To be eligible for coverage under this Limited Warranty, your vehicle must be used primarily for personal, family, and household purposes.
WHAT IS COVERED:
- Our Dealership warrants the workmanship of our labor performed in conjunction with paid repairs or installation for 30 days or 1,000 miles, whichever comes first. The Limited Warranty period shall commence on the date (“Invoice Date”) and odometer reading (“Mileage Out”) that the repairs are completed.
YOUR RESPONSIBILITIES:
- To request coverage under this Limited Warranty, you must notify our Dealership of any failure, malfunction, or defect related to a covered repair.
- You must deliver the vehicle to our Dealership and authorize all repair work to be performed under this Limited Warranty.
- You must retain a copy of your receipt and upon request, be able to present it to us when requesting coverage under this Limited Warranty.
- Upon re-delivery of the vehicle to you, you must pay for any parts, labor, products, expenses, and taxes that our Dealership is not obligated to provide or pay for under this Limited Warranty.
OUR RESPONSIBILITIES:
- If a part fails or malfunctions within the warranty period ONLY due to our workmanship in connection with a covered repair, we will repair or replace the affected part(s) and perform the necessary labor to remedy the failure upon your authorization and subject to the terms of this Limited Warranty. Our Dealership does not cover labor and parts for a faulty part, and in this case whether the manufacturer does or does not replace the part, labor must be paid to Our Dealership again for removal of faulty part AND re-install of the new part.
WHAT IS NOT COVERED:
- Repairs which are still covered by a manufacturer’s warranty or recall or other third party warranty/service contract. (Our Dealership’s Limited Warranty shall be secondary to any such warranty or service contract that provides coverage for repair claims covered hereunder.)
- Parts breaking during installation/removal that couldn’t have been avoided; includes commonly disposable parts (valve stems, TPMS sensors, wheel studs, lug nuts).
- Damage caused by your negligence or your failure to take proper measures to prevent further damage.
- Any failure or damage resulting from: your failure to perform maintenance in accordance with the manufacturer’s recommendations; your failure to maintain appropriate fluid levels (e.g. oil, water, transmission fluid); your continued operation of the vehicle after a warning light notice; an accident or collision; your use of improper or contaminated fluids or fuel; and/or misuse, abuse, tampering, negligence, theft, vandalism, or acts of nature.
- Damage caused by a repair that was not performed by our Dealership.
- Alteration of a part installed by Dealership, by someone other than Dealership.
- Labor, parts, and other costs (ie: cost of lubricants) incurred in connection with the performance of recommended maintenance service.
- Service adjustments, such as calibration or alignments.
- Repairs for which you have not paid.
- Parts installed and/or repairs performed on vehicles used primarily for commercial purposes and purposes such as towing, taxi, limousine services, delivery, hire, on or off road competition, or engaging in a contest of speed or endurance of any type.
- Repairs or installation of parts on vehicles prone to failure are EXCLUDED from any/all warranty. Dealership cannot and will not warranty labor, parts, or performance of said vehicles listed herein. Dealership reserves the right to include a vehicle or scenario to this exclusion list at any time, including vehicles with previously installed performance, offroad, or aftermarket parts by someone other than Dealership.
- All Subarus
- All vehicles with continuously variable transmissions (CVTs)
- All transmissions we performed fluid swap/flushes on
OTHER LIMITATIONS AND EXCLUSIONS:
- In the event the customer supplies the parts for our Dealership to install, our Dealership cannot and will not be liable for any damage incurred by any failure or damage resulting from said parts, or any damage arising from the part not being the correct one for your application/vehicle. By providing your own parts, you authorize Dealership to install your parts and we cannot guarantee fitment, proper function, etc. In the event the part does not fit or work, labor must be paid to Dealership for all time incurred, including installing said part, removing said part, putting the car back to the way it was, and/or getting a correct replacement part to then install again.
- Installation by Dealership of any performance or off-road parts, offer no guarantee that they are legal or compliant in the area customer resides and that Dealership is not liable for anything occurring after installation, including but not limited to law enforcement tickets, vehicle impoundment, legal action, or otherwise.
- Installation by Dealership of any performance or off-road parts, make no guarantee of the performance or longevity of vehicle resulting from installation. Except for the Limited Warranty on the workmanship of our labor as provided herein, this Limited Warranty excludes instances where the vehicle may have adverse reactions to the modifications; ie: motor/transmission failure. We may make recommendations for parts to fit your requested needs, but ultimately it is the Customer’s decision to pay Dealership to install such aftermarket parts, and therefore the Customer is solely responsible & liable for damage it may do to their vehicle. Any instance where a lift kit or otherwise requires notching or welding to the frame or otherwise, Dealership is not liable for voiding vehicle’s manufacturer warranty or for altering its structural integrity. At the time you give Dealership permission to install said kit, you acknowledge the risks and release Dealership from all liability.
- Customer waives the right to the Limited Warranty at any point and time service has been performed on any parts or repairs our Dealership completed, by anyone other than our Dealership. (If anyone other than our Dealership has worked on what we repaired or installed, the warranty is void.)
- Our Dealership reserves the right to inspect the vehicle and any parts removed from or installed in the vehicle both prior to and after a repair is performed pursuant to a claim made under this Limited Warranty.
- The performance of labor to effect repairs is the exclusive remedy available under this express written Limited Warranty.
- The only warranty on parts and products sold in conjunction with repairs performed by our Dealership are those of the manufacturer of the supplier of said parts or products. Except for the Limited Warranty on the workmanship of our labor as provided herein, our Dealership expressly disclaims all warranties, express and implied, including any implied warranties of merchantability and fitness for a particular purpose, and neither assumes not authorize any other person to assume for it any liability in connection with the sale of any parts or products or this repair.
- You are not entitled to recover from our Dealership any consequential damages, damages to property, damages for loss of use, loss of time, loss of profits or income, or any other incidental damages.
